The foreclosure timelines below are meant to give a general idea of how judicial and non-judicial foreclosure proceedings span out.

Non-Judicial Foreclosure Timeline

Ninety days or more of missed payments Your mortgage lender starts the foreclosure process.
Day 1 Next a Notice of Default is filed with either the county clerk or recorder in your jurisdiction.
Within 1 Month Foreclosure notices are now mailed out to everyone who has stake in the property. This includes: Individuals on the note, lien holders, etc...
Within 3 Months of Recording the Notice of Default A Notice of Sale is made and sent out to be published
Within 25 Days of the Published Sale Date The Notice of Sale is now sent to the IRS
Within 20 days of the Published Sale Date At this point, a Notice of Sale is posted on the foreclosed property, printed in the newspaper for 3 weeks, and re-mailed to individuals who showed interest in the property.
5 days Prior to the Published Sale Date. At this point the homeowner no longer has the right to reinstate the loan by bringing their payments current..
Date of Sale The property is now sold in a foreclosure auction to the highest bidder.

Judicial Foreclosure Timeline

Ninety Days or More of Missed Payments Your mortgage lender now starts the foreclosure process.
Day 1 Lender files a Lis Pendens against the homeowner with the county clerk or recorder. A summons and complaint are sent to all parties on the loan and legal proceedings have begun.
20 Days From Receipt of Summons & Complaint. The borrowers on the mortgage need to send a response to the summons and complaint. If a response is not sent, the homeowner risks having a default judgment entered against them.
Within 1-3 Months of Receiving All Legal
Documents from The Parties.
Next the court will set a hearing date where the homeowner has the chance to state why foreclosure should be delayed or dismissed.
Date of the Foreclosure Hearing. During the foreclosure hearing both parties will present their case and evidence. If the judge rules against the homeowner, a sale date is set for a foreclosure auction.
Within 30 days of the Foreclosure Hearing. In most judicial states the homeowner has the right to appeal their foreclosure judgment. The process can be expensive and time consuming though.
Date of Sale Set by the Court. The date of sale for most foreclosures occurs approximately 30 days after the hearing.
